    我国虽然也有了环境立法和环境保护的实践，但并未以立法的形式明确承认公民环境权。而在现行的法律体制下，公民环境权得不到有效的救济，即使有限的救济和补偿，也难以弥补公民环境权益所遭受的侵害。
